RELAY Labour Hire Pty Ltd (RELAY Labour, RELAY, we, us, our) respects your privacy and is committed to handling personal information responsibly.

This Privacy Policy explains how we collect, use, hold, disclose and protect personal information in relation to:

  • our labour hire and recruitment services;
  • candidate registration and worker placements;
  • client and host-site relationships;
  • worker employment, payroll and assignment administration;
  • our website, forms and communications; and
  • our general business operations.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and other applicable privacy laws.

What Is Personal Information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Depending on the nature of your interaction with RELAY, the personal information we collect may include:

  • your name, address, email address and phone number;
  • date of birth and emergency contact details;
  • identification details and Australian work-rights information;
  • employment history, qualifications, skills and experience;
  • resumes, applications and interview records;
  • licences, tickets, registrations and competencies;
  • references and referee details;
  • availability, preferred roles, locations and shift preferences;
  • photographs, ID documents and site-access records;
  • attendance, timesheets, assignment history and performance information;
  • payroll, bank account, superannuation and tax information;
  • client contact details and business correspondence;
  • complaints, investigations, disciplinary matters and workplace feedback;
  • workplace incident, injury, rehabilitation and insurance information; and
  • records of communications with RELAY.

We may also collect technical information when you visit our website, including IP address, browser type, device type, operating system, pages viewed, access times and referring website.

Sensitive Information

Sensitive information may include health information, racial or ethnic origin, criminal history, membership of a professional or trade association, and other categories of protected information.

Where reasonably necessary for our labour hire, employment, safety or legal functions, we may collect sensitive information such as:

  • medical conditions, injuries or workplace restrictions relevant to an assignment;
  • fitness-for-work or medical-assessment information;
  • drug and alcohol testing information where lawfully required;
  • workers compensation and rehabilitation information;
  • criminal-history or background-check information where relevant;
  • information needed to provide appropriate workplace support; and
  • information relating to a workplace incident, complaint or investigation.

We will generally obtain your consent before collecting sensitive information, unless otherwise permitted or required by law.

How We Collect Personal Information

We generally collect personal information directly from you when you:

  • complete a website, candidate or client form;
  • register for work or apply for a role with us;
  • provide a resume or supporting documents;
  • attend an interview or screening call;
  • complete onboarding or employment documentation;
  • provide licences, tickets, qualifications or ID;
  • communicate with us by phone, email, messaging or social media;
  • attend an assignment or perform work through RELAY;
  • complete a timesheet, incident report, complaint or feedback form; or
  • otherwise deal with us.

We may also collect personal information about you from third parties, including:

  • referees and former employers;
  • current or prospective host clients;
  • job boards and recruitment platforms;
  • professional, licensing and registration bodies;
  • training and competency providers;
  • medical, testing or rehabilitation providers;
  • government agencies and regulatory authorities;
  • insurers and workers compensation bodies;
  • payroll, onboarding and recruitment-system providers; and
  • publicly available professional sources where appropriate.

Where you provide us with information about another person, you should have that person's authority and, where appropriate, make them aware of this Privacy Policy.

Why We Collect and Use Personal Information

We collect and use personal information for purposes including:

  • assessing candidate suitability, experience and availability;
  • verifying identity, work rights, tickets, licences and qualifications;
  • matching candidates to suitable construction and civil assignments;
  • presenting suitable candidates to prospective host clients (with your authority);
  • employing, onboarding and placing workers;
  • coordinating site, shift, induction, PPE and assignment requirements;
  • managing attendance, timesheets, payroll, superannuation and allowances;
  • communicating with workers, candidates, clients and referees;
  • monitoring assignment performance and suitability;
  • providing ongoing assignment and replacement support;
  • managing health, safety, workplace incidents, rehabilitation and return to work;
  • administering workers compensation, insurance and legal claims;
  • responding to enquiries, complaints, investigations and disputes;
  • maintaining business, accounting, audit and compliance records;
  • improving our services, systems and website;
  • protecting our legal rights and enforcing contractual obligations;
  • meeting legal, regulatory and reporting requirements; and
  • other authorised or lawful purposes.

We will not use your personal information for an unrelated purpose without your consent or a lawful basis to do so.

Candidate Information and Host Clients

Where a potential assignment is identified, we may discuss it with you and seek your authority to present relevant information to a prospective host client. This may include:

  • your name;
  • experience and employment history;
  • licences, tickets and qualifications;
  • availability and location;
  • suitability for the role; and
  • other information reasonably required by the host client.

Once you are placed on an assignment, we may provide the host client with information reasonably necessary to manage the assignment, including site access, attendance, safety, compliance and performance.

We do not guarantee that registering with RELAY will result in an interview, assignment or ongoing work.

Who We May Disclose Information To

Where reasonably necessary, we may disclose personal information to:

  • prospective and current host clients;
  • referees and former employers;
  • payroll, superannuation and financial-service providers;
  • recruitment, onboarding, timesheet and workforce-management platforms;
  • training, medical, testing and rehabilitation providers;
  • insurers, insurance brokers and workers compensation bodies;
  • WorkSafe, WorkCover, Fair Work, taxation and other government authorities;
  • professional, licensing and registration bodies;
  • IT, cloud storage, cybersecurity and website providers;
  • legal, accounting and other professional advisers;
  • contractors and suppliers supporting our business;
  • related entities or business partners where lawful;
  • your emergency contacts where reasonably necessary;
  • law enforcement, courts, tribunals and regulators; and
  • any other person where you consent or we are authorised by law.

We do not sell or rent personal information to third parties for their independent marketing purposes. We require our service providers to take reasonable steps to protect personal information and to use it only for the services they provide to us.

Overseas Access and Disclosure

Some of our technology, cloud, recruitment, payroll or administrative providers may store, process or access personal information outside Australia.

Our current technology and service providers store and process personal information within Australia. If we engage a provider that stores or processes personal information overseas, we will take reasonable steps to ensure that information is handled consistently with the Australian Privacy Principles, and we will update this policy to identify the relevant country or countries.

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the information is handled consistently with Australian privacy requirements. Overseas recipients may also be subject to their own country's laws.

Website Information, Cookies and Analytics

Our website may use cookies and similar technologies to:

  • enable functionality;

  • understand how visitors use the site;
  • measure performance;

  • improve content and user experience.

We use Google Analytics to understand how visitors use our website and to improve our content and user experience. When you visit our website, technical information such as IP address, device information, browser type, pages visited and interactions with our website may be processed as part of delivering the site and its content.

Direct Marketing

  • available assignments;
  • candidate services and updates;
  • client labour hire services;
  • training or compliance information;
  • business news; and
  • other services offered by RELAY that may be relevant to you.

These communications may be sent by email, phone, SMS, mail or other electronic channels. You may opt out of receiving marketing communications at any time by:

  • using the unsubscribe option in any marketing email;
  • replying and asking to be removed; or
  • contacting us directly.

Opt-out requests will be processed within a reasonable period and free of charge. Operational communications relating to your application, employment, payroll, assignment, a safety matter or an existing client service are not marketing communications and will continue where required.

Anonymity and Providing Limited Information

Where lawful and practical, you may make a general enquiry anonymously or by using a pseudonym.

However, RELAY generally needs accurate identifying information to:

  • assess you for work;
  • verify your work rights and credentials;
  • employ and pay you;
  • manage workplace safety;
  • provide labour hire services to clients; and
  • respond properly to a client request.

If required information is not provided, we may be unable to assess your application, offer an assignment, employ you, provide labour hire services or respond fully to your enquiry.

Security and Storage

We take reasonable technical, physical and organisational measures to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure.

Personal information may be held in:

  • recruitment and onboarding platforms;
  • payroll and timesheet systems;
  • secure cloud-based systems;
  • electronic databases;
  • email and business systems; and
  • secure physical records where required.

Access is limited to authorised personnel who require the information for legitimate business functions.

No method of electronic transmission or storage is completely secure. While we take reasonable safeguards, we cannot guarantee absolute security. Please avoid sending highly sensitive information via unsecured channels unless we have requested it and provided an appropriate method.

Retention and Disposal

We retain personal information for as long as reasonably required for:

  • recruitment and candidate consideration;
  • employment and assignment administration;
  • payroll, taxation and superannuation obligations;
  • workplace safety and workers compensation;
  • legal, insurance, audit and compliance requirements;
  • resolving disputes and complaints; and
  • other legitimate business purposes.

When personal information is no longer required and we are not required by law to retain it, we take reasonable steps to securely destroy or de-identify it.

Data Breaches

RELAY maintains processes for responding to suspected privacy or data-security incidents. Where a breach is likely to result in serious harm and notification is required under applicable law, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

Accessing and Correcting Your Information

You may request access to the personal information we hold about you, or ask us to correct information that is inaccurate, outdated, incomplete, irrelevant or misleading, by contacting our Privacy Officer (see below).

We may need to verify your identity before actioning your request.

Privacy law may in some circumstances permit us to refuse access or correction. Where legally permitted, we will explain the reasons and advise you of your complaint options.

We will respond within a reasonable period. There is no charge for making a request, although reasonable costs for providing access may apply where permitted by law.

Privacy Complaints

If you wish to make a privacy complaint, please contact our Privacy Officer in writing with:

  • your name and contact details;
  • a description of your privacy concern;
  • relevant dates and communications; and
  • the outcome you are seeking.

We will acknowledge your complaint and investigate it, aiming to respond within 30 days. Complex matters may take longer, and we will keep you informed.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

Our website may contain links to job boards, host clients, social media, or other third-party websites. RELAY does not control the privacy practices or content of these external websites. Please review each external site's privacy policy before providing personal information.

RELAY may update this Privacy Policy from time to time as our services, systems, providers, legal obligations or information-handling practices change. The current version will be published on our website with the date of the latest update.
